Virtual Sleep Care Inc.
Website Terms of Use
Effective August 25, 2026
1. Acceptance and scope
These Terms govern access to and use of the Virtual Sleep Care website, ecommerce store, subscriptions, educational resources, virtual-care services, home sleep testing, CPAP therapy support, patient-support channels, and related services. By using the Services, you agree to these Terms and applicable service-specific policies, consents, notices, and agreements.
2. Important medical information
Website content is general information, not a diagnosis, treatment plan, prescription, clinical order, or substitute for individualized advice. Virtual Sleep Care is not an emergency service. Do not use the website, online messages, ecommerce store, or routine virtual-care services for urgent or emergency concerns; call 911 or seek immediate emergency care when needed.
Clinical services are initially available in British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, New Brunswick, Nova Scotia, Prince Edward Island, and Newfoundland and Labrador. They are not initially available in Quebec or the Territories. Availability depends on professional licensing, clinical suitability, and the service requested.
3. Clinical services, consents, and monitoring
Qualified healthcare professionals exercise independent professional judgment. Where a service-specific consent, care agreement, prescription, or clinical notice applies, it governs for that service to the extent required by law. Remote PAP monitoring is not continuous or real-time monitoring, is not an emergency-response service, and does not guarantee review at a particular time unless a specific program expressly says otherwise.
4. Orders, payments, and subscriptions
Orders are subject to acceptance, availability, and applicable terms. Payments are processed through Stripe or PayPal using WooCommerce, according to the options available at checkout. Orders containing the diagnostic home sleep test use Stripe at launch. Virtual Sleep Care does not store full payment-card numbers.
Subscriptions are not available at launch. The subscription provisions in this section apply only to a future subscription that you separately choose to join after reviewing its terms. Current purchases do not enrol you in recurring billing.
Where you enroll in a subscription, renewal frequency and eligible replacement items may depend on your preferences, plan, prescription, and insurance coverage. For example, coverage may permit a new CPAP mask, tubing, or water chamber every six months and a replacement CPAP device approximately every five years. You remain responsible for reviewing the applicable checkout and subscription disclosures.
5. Communications and AI
Order confirmations, receipts, renewal notices, shipping updates, payment messages, safety notices, and service communications are operational communications, not marketing. Marketing messages are managed in accordance with applicable consent requirements.
AI and automated tools may support educational content, customer support, workflow, administration, and quality improvement. They are not used as the sole basis for diagnosis, prescribing, treatment recommendations, or other clinical decisions.
6. Consumer rights, law, and contact
Nothing in these Terms limits rights or remedies that cannot lawfully be excluded or limited under applicable Canadian federal, provincial, or territorial law. These Terms are governed by the laws of New Brunswick and the applicable federal laws of Canada. Subject to non-waivable consumer rights, courts in New Brunswick, Canada have exclusive jurisdiction.
